Terms of Use

These Terms of Use ("Terms") apply to every person who accesses or uses the website located at halvorial.com (the "Site"), operated by Halvorial Broadcasting (Pty) Ltd, a Pty Ltd duly registered in South Africa under registration number 3471483041, trading as Halvorial ("Halvorial", "the Company", "we", "us" or "our"). These Terms are effective from 2026-01-01 and govern access to and use of the Site, including the broadcast-related information, programming schedules, editorial content, contact form and email subscription service made available through it. By accessing or using the Site, the user ("user", "you") accepts these Terms in full. A user who does not agree to these Terms must discontinue use of the Site immediately.

1. Interpretation and Scope

1.1 In these Terms, "Content" means all text, graphics, images, audio, video, schedules, programme descriptions, logos and other material made available on the Site by Halvorial or its licensors.

1.2 These Terms apply to all visitors to the Site, including those who submit information through the contact form, those who subscribe to the email newsletter, and any other person who otherwise interacts with the Site's functionality.

1.3 These Terms must be read together with the Site's Privacy Policy and Cookie Policy, both of which are incorporated into these Terms by reference and available at halvorial.com/privacy.html and halvorial.com/cookies.html respectively.

2.1 Halvorial is the trading name of Halvorial Broadcasting (Pty) Ltd, a company incorporated in the Republic of South Africa and registered with the Companies and Intellectual Property Commission (CIPC) under registration number 3471483041.

3. The Services Provided

3.1 Halvorial operates a broadcast media website providing programming information, editorial and promotional content relating to its television broadcasting activities ("Services"). The Site further enables users to (a) submit enquiries through a contact form, and (b) subscribe to receive email updates and newsletters concerning Halvorial's programming and related announcements.

3.2 Halvorial reserves the right, at its sole discretion, to modify, suspend, or discontinue any part of the Services, including the availability of the contact form or the email subscription facility, at any time and without prior notice, save where notice is required by applicable law.

4. Use of the Contact Form

4.1 Any user who submits an enquiry through the Site's contact form warrants that the name, email address and message content provided are accurate, current and submitted by the user in their own right or with the necessary authority to do so on behalf of another.

4.2 Submissions made through the contact form must not contain unlawful, defamatory, threatening, obscene or otherwise objectionable material. Halvorial reserves the right to disregard, and to decline to respond to, any submission that it reasonably considers to breach this clause.

4.3 Halvorial does not guarantee a response time to enquiries submitted through the contact form and accepts no liability for any delay in responding, save where such liability cannot lawfully be excluded.

5. Email Subscription Service

5.1 A user who subscribes to Halvorial's email newsletter consents to receive periodic communications relating to programming updates, broadcast schedules and related promotional material by email.

5.2 Every subscription email issued by Halvorial shall contain a mechanism enabling the recipient to unsubscribe. A user may withdraw consent to receive such communications at any time by using the unsubscribe link provided or by contacting [email protected].

5.3 Halvorial shall process subscriber data in accordance with the Protection of Personal Information Act, 2013 ("POPIA"), further particulars of which are set out in the Privacy Policy.

6. Intellectual Property

6.1 All Content displayed on the Site, including all trademarks, logos, broadcast schedules, editorial text and audio-visual material, is the property of Halvorial, its licensors, or its content partners, and is protected by South African copyright, trademark and related intellectual property laws.

6.2 No part of the Site or its Content may be reproduced, distributed, publicly displayed, modified or otherwise exploited for commercial purposes without the prior written consent of Halvorial, save to the extent that reproduction for personal, non-commercial use is expressly permitted by law.

6.3 Nothing in these Terms transfers any intellectual property right in the Content to the user. Use of the Site does not confer any licence beyond that necessary for ordinary, non-commercial browsing of the Site.

7. Acceptable Use

7.1 The user undertakes not to use the Site in any manner that: (a) breaches any applicable South African law or regulation; (b) infringes the intellectual property, privacy or other rights of Halvorial or any third party; (c) introduces viruses, malware or other harmful code; (d) attempts to gain unauthorised access to the Site's servers, systems or networks; or (e) interferes with or disrupts the proper functioning of the Site.

7.2 Halvorial reserves the right to restrict or terminate a user's access to the Site, including the contact form and email subscription facility, where it reasonably believes this clause has been breached.

8. Third-Party Links and Content

8.1 The Site may contain links to third-party websites or services that are not owned or controlled by Halvorial. Such links are provided for convenience only and do not constitute an endorsement of the linked content.

8.2 Halvorial accepts no responsibility for the content, accuracy, or practices of any third-party website accessed via a link on the Site, and users access such sites entirely at their own risk.

9. Disclaimer of Warranties

9.1 The Site and its Content are provided on an "as is" and "as available" basis. Halvorial makes no representation or warranty, express or implied, that the Site will be uninterrupted, error-free, secure, or free from viruses or other harmful components.

9.2 Programming schedules and related information published on the Site are provided for general informational purposes and may be amended by Halvorial without notice. Halvorial does not warrant the accuracy or completeness of such information at any given time.

10. Limitation of Liability

10.1 To the maximum extent permitted by South African law, Halvorial, its directors, employees and agents shall not be liable for any direct, indirect, incidental, special or consequential loss or damage arising out of or in connection with the use of, or inability to use, the Site, including loss of data, revenue or business opportunity.

10.2 Nothing in these Terms shall be construed as excluding or limiting liability for gross negligence, wilful misconduct, or any liability that may not lawfully be excluded under the Consumer Protection Act, 2008 or any other applicable law.

11. Indemnity

11.1 The user agrees to indemnify and hold harmless Halvorial, its directors, employees and agents against any claim, loss, liability, cost or expense (including reasonable legal costs) arising from the user's breach of these Terms or misuse of the Site.

12. Protection of Personal Information

12.1 Halvorial processes personal information collected through the Site, including via the contact form and email subscription facility, in accordance with POPIA. Full details of the personal information collected, the purposes and legal bases of processing, retention periods, and the rights available to data subjects are set out in the Privacy Policy at halvorial.com/privacy.html.

13. Amendments to These Terms

13.1 Halvorial reserves the right to amend these Terms from time to time. The version published on the Site at any given time shall govern use of the Site from that date. Material amendments will be indicated by an updated effective date at the head of this page.

13.2 Continued use of the Site following the publication of amended Terms constitutes acceptance of those Terms. A user who does not accept amended Terms must discontinue use of the Site.

14. Governing Law and Jurisdiction

14.1 These Terms are governed by the laws of the Republic of South Africa.

14.2 The parties submit to the non-exclusive jurisdiction of the courts of the Republic of South Africa in respect of any dispute arising out of or in connection with these Terms or the use of the Site.

15. General

15.1 Should any provision of these Terms be found unlawful, void, or unenforceable by a court of competent jurisdiction, that provision shall be severed and the remaining provisions shall continue in full force and effect.

15.2 No failure or delay by Halvorial in exercising any right under these Terms shall constitute a waiver of that right.

15.3 These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between the user and Halvorial in relation to use of the Site, and supersede any prior understanding or agreement, whether written or oral.
